HMRC Debts

Tax & VAT arrears

HMRC have become increasing aggressive  in recent years in pursuit of unpaid tax. They expect tax to be paid within the agreed time period. As a business owner or company director you must ensure that they retain confidence in your ability to pay tax due. Failure to keep to a  payment arrangement will often lead to an immediate demand for payment in full

HMRC Threatening Letters

Receiving threatening letters from HMRC about unpaid VAT, Paye or Tax is a sure sign of a business in difficulty -usually with cash flow issues. As HMRC is a major source of winding up petitions and bankruptcy proceedings against businesses it is wise to deal with them promptly. Early engagement with HMRC will generally lead to a "time to pay" arrangement to allow your business to bring payments up to date

Dealing with HMRC
  • Don't ignore letters
  • Keep records up to date
  • File returns on time
  • Engage with HMRC
  • Negotiate time to pay

Further HMRC actions

If you do not respond to HMRC demands for payment of arrears or agree a time to pay arrangement with them, HMRC may pursue a demand for payment by applying for a County Court Judgement against you or your company. That is serious as it can lead to enforcement action, bankruptcy proceedings against you if you are a sole trader or a winding up petition (Compulsory Liquidation) if you are a Company director. Another action which HMRC may take is to apply to a county court to issue a Statutory demand for  payment of the debt-Again this can have serious implications
