County Court Bailiffs

County  Court Bailiffs or Enforcement Agents have official authority conferred upon them by the Courts. They are employed by HM Courts & Tribunals service and certificated by a County Court Judge.
In addition to County Court judgements awarded in favour of a creditor they can enforce payment of -rent arrears, council tax arrears, non-domestic rates, parking fines, child maintenance.
County Court Bailiffs can also act under the direction of a High Court Enforcement Officer to enforce  any High Court Writs. They act under several regulations:
  • Tribunal Courts & Enforcement Act 2007
  • Taking Control of  Goods regulations 2013
  • Taking Control of Goods (fees) Regulations 2014
They act in accordance with specifically defined cost structures and fees

County Court Judgements

County Court Bailiffs or Enforcement Agents will often act to enforcement a County Court Judgement issued in favour of a creditor in order to recover payment of a debt . If necessary they will seek to execute a Warrant of control in order to take control of possessions or assets to cover the value of the debts plus costs.
Enforcement Officers appointed by the courts must give at least 7 days clear notice of a visit to your premises .
This is known as the enforcement notice period and it must allow 7 clear days prior  to  the visit-not including Sundays and Bank Holidays
The Warrant of Control gives the Enforcement Agent the right to take control of goods once the notice of enforcement has expired
